Adults 21 and older may carry up to 3 ounces of cannabis flower and 24 grams of concentrate. At a private residence, up to 5 pounds may be kept if stored securely. Medical patients have a separate practitioner-certified 60-day supply framework. Public use and impaired driving remain prohibited.
Adults 21 and older may grow up to 3 mature and 3 immature plants per person, with a household limit of 6 mature and 6 immature plants. Growing must occur at the private residence, and homegrown cannabis may not be sold, traded, or bartered.
For this section, adult means a person 21 or older. A personal home grow is separate from a commercial cultivation license: the allowance only covers personal, noncommercial cultivation by eligible adults who follow the residence, plant-count, security, visibility, landlord, and local-rule limits described above.
Regulator: New York Office of Cannabis Management, overseen by the Cannabis Control Board
License classes:
Caps: There is no statewide numeric cap. OCM processed more than 2,300 licenses through November 2025 and continued monthly Cannabis Control Board approvals in 2026.
Integration model: General adult-use licensing uses a two-tier system separating supply from retail. Microbusinesses and medical registered organizations are exceptions.
Round status: Applications proceed in Cannabis Control Board-approved rounds, with continuing regular approvals rather than a market-opening rollout.
Local control: Municipalities had until December 31, 2021 to opt out of retail dispensaries and/or on-site consumption; they may opt back in.
Jobs outlook: New York has a mature, growing adult-use market. Licensed dispensaries rose from about 610 in March to roughly 683 in June 2026, but counts should always be published with an as-of date.
