New Mexico has adult-use and medical cannabis. Adults 21 and older may buy, possess, and grow limited amounts, while the state allows more cannabis to be kept at home if it is not visible from a public place. The Cannabis Control Division runs an uncapped, rolling-license market.
Adults 21 and older may possess up to 2 ounces of flower, 16 grams of extract, and 800 milligrams of edible cannabis outside the home. There is no possession cap inside a private residence if excess is not visible from a public place. Visitors receive the same adult-use access. Medical patient purchases follow separate DOH program rules.
Adults 21 and older may grow up to 6 mature and 6 immature plants per person, with no more than 12 mature plants per household. Plants must not be visible from public places, and homegrown cannabis cannot be sold.
For this section, adult means a person 21 or older. A personal home grow is separate from a commercial cultivation license: the allowance only covers personal, noncommercial cultivation by eligible adults who follow the residence, plant-count, security, visibility, landlord, and local-rule limits described above.
Regulator: Cannabis Control Division, New Mexico Regulation and Licensing Department
License classes:
Caps: There are no statewide license caps. The latest official figure located was about 3,071 business licenses issued as of December 2024; no current 2026 type-by-type count was found.
Integration model: Vertical integration is permitted through a dedicated license type, but it is not required.
Round status: Applications are rolling and online. A retail-license pause has been discussed but no moratorium is currently in effect.
Local control: Municipalities and counties may set reasonable time, place, and manner rules but cannot ban licensed businesses; they may opt out only of cannabis consumption areas.
Jobs outlook: The uncapped, statewide market provides relatively open hiring across retail, cultivation, manufacturing, delivery, and integrated businesses, though current license counts should be rechecked before quantifying demand.

A completed cannabis possession, use, manufacture, distribution, or dispensing conviction is not substantially related to licensure and cannot be the sole basis for denial. The statute instead identifies narrow disqualifiers, including certain fraud, deceit, embezzlement, or minor-involving controlled-substance felonies. SB 2 provides automatic dismissal and expungement for conduct made legal by the Cannabis Regulation Act.
Yes. Adults 21 and older may buy, possess, and use cannabis under the Cannabis Regulation Act. Licensed adult-use retail sales began on April 1, 2022.
Outside the home, adults may possess up to 2 ounces of flower, 16 grams of extract, and 800 milligrams of edibles. More may be kept at a private residence if it is not visible from a public place.
Yes. Adults 21 and older may grow up to 6 mature and 6 immature plants each, with a household limit of 12 mature plants. Homegrown cannabis cannot be sold.
Generally no. Dispensary, cultivation, and manufacturing staff do not need a general state worker badge. Only servers at licensed cannabis consumption areas need a cannabis server permit, which may be obtained within 30 days after starting work.
A completed cannabis conviction cannot be the sole reason to deny a license because New Mexico law says it is not substantially related to licensing qualifications. Separate narrow felony disqualifiers still apply.
