1. Acceptance of Terms

NugWork (“the Platform”, “we”, “us”, or “our”) is a software-as-a-service (SaaS) job board exclusively serving the legal cannabis industry. The Platform connects employers in the cannabis sector with job seekers. NugWork does not sell, distribute, cultivate, process, transport, or otherwise handle cannabis or cannabis-derived products of any kind. All transactions on this Platform are for job posting and recruitment services only.

By accessing, browsing, or using NugWork in any way — including creating an account, posting a job, applying for a position, subscribing to email notifications, or simply viewing job listings — you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and our Refund & Cancellation Policy, each of which is incorporated herein by reference. If you do not agree to these Terms, you must immediately stop using the Platform.

2. User Eligibility

You must be at least 21 years of age to use NugWork. By using the Platform, you represent and warrant that you are 21 or older and have the legal capacity to enter into a binding agreement. If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Employers must operate within the bounds of applicable federal, state, and local law. Because cannabis regulations vary by jurisdiction, employers are solely responsible for ensuring their job postings and hiring activities comply with all laws in their operating jurisdiction(s). NugWork does not verify the legal status, licensing, or regulatory compliance of any employer listed on the Platform and disclaims all liability arising from employer non-compliance.

3. Account Registration & Security

To access certain features — including posting jobs, applying for positions, and managing your profile — you must create an account. NugWork offers two registration methods:

  • Email-based registration: You provide an email address and password. Your email must be confirmed before your account is fully activated.
  • Username-only registration: You may create an account with a username and password without providing an email address. Username-only accounts have limited functionality (e.g., password recovery requires a verified email).

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify us of any unauthorized use of your account. NugWork is not liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for any reason including suspected fraudulent activity or violation of these Terms.

You may not create multiple accounts to circumvent Platform limits (such as the free listing limit), impersonate others, or for any other deceptive purpose. We reserve the right to merge or delete duplicate accounts without notice.

4. Employer Job Listing Terms

Employers may post job listings on the Platform under free or paid tiers, subject to the following terms:

  • Free listings are limited to 1 active listing per account at any time and expire after 3 days. Free listings require admin review and approval before going live and are subject to removal at our sole discretion at any time without notice. There is no guarantee that a free listing will be approved. Free listings may receive lower placement in search results compared to paid listings.
  • Paid listings (Standard) are activated upon successful payment processing and remain active for 30 days from the date of activation. Standard listings include access to the employer dashboard with applicant management and analytics features.
  • Paid listings (Featured) receive all Standard benefits plus premium placement at the top of search results, highlighting in weekly email digests, and visual distinction on the Platform.
  • All listing tiers, pricing, benefits, and durations are subject to change at any time at our sole discretion. Changes will not retroactively affect listings that are already active at the time of the change.

Payment & Billing

  • All fees are stated in USD. Payments are processed securely via PaymentCloud, our PCI-DSS certified payment provider. NugWork uses PaymentCloud’s hosted payment page — card data is entered directly on PaymentCloud’s servers and is never transmitted to or stored on NugWork’s systems. NugWork does not store, process, or have access to full payment card numbers, CVV codes, or other sensitive cardholder data.
  • Refunds are handled in accordance with our Refund & Cancellation Policy. In general, all sales are final once the listing is activated.
  • NugWork reserves the right to remove any listing that violates these Terms, is inaccurate, fraudulent, or is otherwise determined to be inappropriate, without refund.

Auto-Renewal Subscriptions

Where available, employers may opt into auto-renewal for paid listings. Auto-renewal creates a recurring monthly subscription that automatically charges the payment method on file and renews the listing for an additional 30-day period upon expiration. By enabling auto-renewal, you authorize NugWork and its payment provider to charge the applicable fee on a recurring basis until you cancel. You may cancel auto-renewal at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods.

5. Job Seeker Terms

Browsing job listings and applying for positions on NugWork is free for job seekers. Creating an account is required to apply for positions. NugWork does not charge job seekers any fees for accessing listings or submitting applications.

NugWork does not guarantee employment, interview invitations, or any particular outcome from using the Platform. The hiring decision rests solely with the employer. NugWork is not a party to any employment relationship between job seekers and employers and has no responsibility for the actions, decisions, or conduct of either party.

Resume Uploads

Job seekers may upload a resume (PDF, DOC, or DOCX format, maximum 5 MB) to their profile. Resumes are stored securely and are shared with employers only when you apply for a specific position. By uploading a resume, you represent that it is truthful and accurate to the best of your knowledge and that you have the right to share its contents. NugWork is not responsible for how employers use, store, or dispose of resume data once it has been transmitted via an application. You may delete your resume from your profile at any time.

Applications

When you apply for a job, your name, resume, and any cover note you provide are transmitted directly to the employer’s designated email address. This transmission is irreversible — once sent, NugWork cannot recall or delete application materials from the employer’s inbox. You are responsible for the content of your applications.

6. Aggregated & Publicly Sourced Job Listings

In addition to listings submitted directly by employers, NugWork displays job listings that have been sourced from publicly accessible third-party websites and APIs — including employer career pages (via the Greenhouse job board API), cannabis-specific staffing platforms (Vangst, FlowerHire via the Engin API), and third-party job aggregation services (Remotive, Adzuna, Jooble, and USAJobs.gov). These listings are aggregated in good faith to help job seekers discover opportunities across the cannabis industry in one place.

NugWork makes no representation or warranty that aggregated listings are current, accurate, complete, or still accepting applications. Job seekers should verify listing details directly with the employer before applying. NugWork disclaims all liability for any damages, losses, or missed opportunities arising from reliance on aggregated listing information.

Removal requests: If you are a representative of a company whose job listings appear on NugWork without authorization, or if you would like a listing removed for any reason, please contact us at hello@nugwork.net with the subject line “Listing Removal Request” and we will remove the listing promptly — typically within 2 business days.

Claim your listing: If you are an employer or authorized representative who owns a job listing that appears on NugWork as an aggregated listing, you may claim it and transfer it to your employer dashboard — giving you access to applicant analytics, listing management, and other platform features. To do so, email founder@nugwork.net with the subject line “Listing Claim Request” and include sufficient verification of your ownership or authority over the listing (e.g., a company email address, business registration details, or other documentation). Once verified, we will associate the listing with your NugWork employer account at no additional charge.

7. Founding Member Program

NugWork designates select early users as “Founding Members” at our sole discretion. Founding Member status is strictly limited to a maximum of 50 users across the lifetime of the Platform. Once the 50-seat limit is reached, no additional Founding Member badges will be issued.

Founding Members receive the following benefits for as long as their account remains active and in good standing:

  • Lifetime 15% discount on all paid job listings (Standard and Featured). This discount applies automatically at checkout and is non-transferable, non-combinable with other promotional offers, and has no cash value.
  • Priority listing placement: Founding Member job listings are sorted above regular paid listings (but below Featured listings) in search results on the Platform.
  • Profile highlighting: Founding Member profiles are visually distinguished on the Platform with an exclusive badge and styling.

Founding Member status is non-transferable and may be revoked at our sole discretion for violation of these Terms. While we intend to honor Founding Member benefits in perpetuity, NugWork reserves the right to modify or discontinue specific benefits with reasonable notice. The lifetime discount benefit will not be removed without at least 30 days’ written notice to the affected user’s registered email address.

8. User Content & Conduct

“User Content” refers to all information, data, text, and materials that you submit, upload, or transmit through the Platform, including but not limited to job listing descriptions, company profiles, resumes, cover notes, and contact form messages.

You are solely responsible for all User Content you submit. By submitting User Content, you represent and warrant that:

  • You own or have the necessary rights and permissions to submit the content.
  • The content is truthful, accurate, and not misleading.
  • The content does not violate the rights of any third party, including intellectual property, privacy, or publicity rights.
  • The content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material.
  • The content does not contain viruses, malware, or any other harmful code.

NugWork does not pre-screen all User Content (other than free listings subject to admin review) and is not responsible for the accuracy, legality, or appropriateness of User Content. We reserve the right to remove, edit, or refuse to publish any User Content at our sole discretion and without notice.

9. Prohibited Conduct

You agree not to use the Platform to:

  • Post fraudulent, misleading, or discriminatory job listings.
  • Post listings for positions that do not exist or for purposes other than genuine employment.
  • Collect, harvest, scrape, or mine user data, job listings, or any Platform content using automated means (bots, crawlers, spiders, or similar technology) without our express written consent.
  • Send unsolicited commercial communications (spam) to other users.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload or transmit malware, viruses, or any malicious code.
  • Attempt to gain unauthorized access to any part of the Platform, its servers, databases, or related systems or networks.
  • Interfere with or disrupt the integrity, performance, or availability of the Platform or its infrastructure.
  • Circumvent, disable, or otherwise interfere with any security or access control features of the Platform, including the creation of multiple accounts to bypass free listing limits.
  • Use the Platform for any purpose other than legitimate cannabis industry employment activities.
  • Use the Platform to facilitate the sale, purchase, distribution, or trafficking of cannabis or any other controlled substance.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
  • Violate any applicable local, state, federal, or international law or regulation.

NugWork reserves the right to suspend or permanently terminate accounts found to be in violation of these prohibitions, without refund and without prior notice.

10. Email Communications

By creating an account or subscribing to our email digest, you consent to receive the following types of email communications from NugWork:

  • Transactional emails: Account confirmations, password resets, application notifications, and other service-related messages necessary for the operation of your account. These cannot be opted out of while your account remains active.
  • Weekly digest emails: If you subscribe to our job digest, you will receive periodic emails featuring new job listings matching your preferences. You may unsubscribe at any time using the unsubscribe link included in each digest email.

11. Intellectual Property

All content on the Platform that is not User Content — including the NugWork name, logo, design, layout, software, algorithms, visual elements, and written content — is owned by or licensed to NugWork and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform content without our express written permission.

By submitting User Content to the Platform (such as a job listing, resume, or profile information), you grant NugWork a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and transmit that content on and through the Platform for the purposes of operating, promoting, and improving the service. This license continues for as long as the content remains on the Platform and terminates upon deletion, except where the content has already been transmitted to third parties (e.g., applications sent to employers) or is retained as required by law.

Copyright Complaints (DMCA)

If you believe that content on NugWork infringes your copyright, please notify us at hello@nugwork.net with the subject line “DMCA Notice” and include: (a) a description of the copyrighted work; (b) the URL of the infringing content; (c) your contact information; (d) a statement that you have a good-faith belief the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized to act on behalf of one. We will respond to valid notices in accordance with applicable law.

12. Cannabis Industry Disclaimer

NugWork is a job board and recruitment platform only. We do not cultivate, manufacture, process, distribute, sell, or otherwise handle cannabis, hemp, or cannabis-derived products. We do not facilitate the purchase, sale, or exchange of cannabis in any form.

Cannabis remains a controlled substance under federal law in the United States. While many states have legalized cannabis for medical and/or adult use, users of this Platform acknowledge that federal and state laws may conflict. NugWork does not provide legal advice and makes no representation regarding the legality of any employer’s operations, any job listing, or any employment activity posted on or facilitated through the Platform.

Users are solely responsible for understanding and complying with all applicable laws, regulations, licensing requirements, and industry-specific compliance obligations in their respective jurisdictions. NugWork disclaims all liability for any legal consequences arising from your participation in the cannabis industry, whether as an employer or job seeker.

NugWork does not collect or process any cannabis-related health data, medical records, dispensary patient information, or cannabis consumption history. Job seekers are solely responsible for disclosing or withholding information about their cannabis use history in their applications. NugWork does not advise on employment eligibility, background check requirements, or drug testing policies.

13. Third-Party Services & Links

The Platform relies on third-party service providers for certain functionality, including but not limited to:

  • PaymentCloud for payment processing (PCI-DSS certified hosted payment page)
  • Vercel for application hosting, edge CDN, and privacy-preserving site analytics
  • PostHog (session analytics, may be used — see Privacy Policy)
  • Supabase for database hosting, authentication, and file storage
  • Resend for transactional and marketing email delivery
  • Greenhouse job board API for sourcing employer career listings
  • Engin API for sourcing cannabis staffing listings (FlowerHire)
  • Remotive API for sourcing remote job listings
  • Adzuna API for sourcing job aggregation data
  • Jooble API for sourcing job aggregation data
  • USAJobs.gov API for sourcing federal government job listings

Your use of the Platform may be subject to the terms and privacy policies of these third-party providers. NugWork is not responsible for the availability, accuracy, security practices, or content of any third-party service and disclaims all liability arising from third-party service failures, data breaches, or errors.

Job listings may contain links to external websites, including employer career pages and application portals. Aggregated listings sourced from third-party APIs (such as Adzuna, Jooble, Remotive, USAJobs.gov, Greenhouse, and Engin) may redirect you to the original source or employer site when you apply. NugWork does not control these external sites and is not responsible for their content, privacy practices, or availability. Clicking on an external link is at your own risk.

14. No Employment Relationship

NugWork is not an employer, staffing agency, employment agency, or recruiter. We are a technology platform that facilitates connections between employers and job seekers. NugWork is not a party to any employment contract, offer, negotiation, or arrangement between users of the Platform.

NugWork does not:

  • Screen, verify, or endorse any employer, job listing, or job seeker.
  • Guarantee the accuracy of any information provided by employers or job seekers.
  • Guarantee that any job listing will result in employment.
  • Verify employer licensing, insurance, or regulatory compliance status.
  • Conduct background checks, drug tests, or reference checks.
  • Mediate disputes between employers and job seekers.

You acknowledge that NugWork bears no responsibility for the hiring decisions, workplace conditions, compensation practices, or conduct of any employer listed on the Platform, nor for the qualifications, honesty, or conduct of any job seeker.

15. Employer Data Responsibilities

When a job seeker applies to your listing, their application materials — including their name, resume, and any cover note — are transmitted to you via email. As an employer, you agree to:

  • Handle applicant data in compliance with all applicable privacy and employment laws.
  • Use applicant data solely for the purpose of evaluating and responding to their application.
  • Not sell, share, or otherwise distribute applicant data to third parties without the applicant’s consent, except as required by law.
  • Maintain reasonable security measures to protect applicant data from unauthorized access or disclosure.
  • Comply with all applicable anti-discrimination laws in your hiring practices.

NugWork is not responsible for employer handling of applicant data after it has been transmitted. Any disputes regarding employer use of applicant data are solely between the employer and the applicant.

16. Account Termination & Deletion

You may delete your account at any time from your profile settings. Account deletion requires password confirmation. Upon deletion:

  • Your profile data, stored resume, and account credentials are permanently deleted.
  • Your personal information will be deleted or anonymized within 30 days, except where retention is required by law.
  • Active paid listings will remain visible until their expiration date but will no longer be manageable.
  • Applications you have already submitted cannot be recalled — they have already been transmitted to employers.
  • Any active auto-renewal subscriptions associated with your account should be cancelled before deletion; NugWork is not liable for charges incurred after account deletion if subscriptions were not cancelled.

NugWork may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination by NugWork, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

17. Analytics & Tracking

NugWork uses the following analytics tools:

  • Vercel Analytics: Cookieless, privacy-preserving site analytics. No cookies are set and no personally identifiable information is transmitted to Vercel.
  • PostHog (may be used): Session event analytics including page views, click events, and session recordings via a first-party cookie. No health or financial data is collected. You may opt out by enabling the Do Not Track (DNT) signal in your browser or by contacting us at privacy@nugwork.net.

Analytics data is used to improve the Platform and to provide employers with listing performance metrics (view counts and application click counts). For full details, see our Privacy Policy.

18. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NUGWORK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NUGWORK DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION ON THE PLATFORM, INCLUDING JOB LISTINGS, EMPLOYER INFORMATION, OR USER PROFILES.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM NUGWORK OR THROUGH THE PLATFORM SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NUGWORK AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
  • COST OF PROCUREMENT OF SUBSTITUTE SERVICES
  • PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR ACCESS TO OR USE OF THE PLATFORM
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM
  • ANY EMPLOYMENT OR HIRING DECISIONS MADE BASED ON INFORMATION AVAILABLE ON THE PLATFORM
  • ANY LEGAL CONSEQUENCES ARISING FROM YOUR PARTICIPATION IN THE CANNABIS INDUSTRY
  • THE ACTIONS, OMISSIONS, OR CONDUCT OF ANY EMPLOYER, JOB SEEKER, OR OTHER USER

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF NUGWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any and all claims arising from or related to your use of the Platform shall not exceed the greater of (a) the amount you paid to NugWork in the 12 months preceding the event giving rise to the claim, or (b) fifty dollars ($50 USD).

20. Indemnification

You agree to indemnify, defend, and hold harmless NugWork and its owners, officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of or access to the Platform.
  • Your violation of these Terms.
  • Your violation of any law, regulation, or third-party right.
  • Any User Content you submit to the Platform.
  • Your employment-related activities, decisions, or disputes arising from use of the Platform.
  • Any claim by a third party related to your job listing, application, or use of the Platform.

This indemnification obligation survives the termination of your account and these Terms.

21. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform, you agree to first attempt to resolve the dispute informally by contacting us at hello@nugwork.net. We will attempt to resolve the dispute within 30 days from the date of initial contact.

If the dispute cannot be resolved informally, you agree that it shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration provider in accordance with its then-current rules. The arbitration shall be conducted in the State of Delaware. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against NugWork.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent that arbitration is not applicable, any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

23. Force Majeure

NugWork shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government or regulatory bodies, pandemics, internet or telecommunications failures, cyberattacks, power outages, changes in applicable law (including changes to cannabis regulations at the federal or state level), or acts of war or terrorism.

24. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

25. Entire Agreement & Waiver

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and NugWork regarding your use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

The failure of NugWork to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of NugWork.

26. Changes to These Terms

We may update these Terms from time to time at our sole discretion. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will make reasonable efforts to notify registered users by email or by a prominent notice on the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and delete your account.
