Cannabis Laws by State
Montana has adult-use and medical cannabis. Adults 21 and older may possess a limited personal amount and grow a secured home crop. Adult-use dispensaries operate only in green counties, while red counties remain medical-sales-only. A statewide moratorium prevents new business premises through June 30, 2027.

A person 21 or older or a registered cardholder may possess up to one ounce of usable marijuana, including no more than eight grams of concentrate and 800 milligrams of THC in solid edible products. Home-grown marijuana above one ounce must be kept in a locked space at the residence.
An adult may grow up to two mature plants and two seedlings at a private residence. A registered medical cardholder may grow four mature plants and four seedlings. A household may have no more than twice the applicable individual amount. Plants and excess product must be locked and not visible by normal unaided vision from a public place.
Home cultivation is limited to the registered patient, caregiver, or provider groups described above. Being an adult by itself does not authorize a grow in Montana; the person cultivating must fit the medical-program rule and follow its plant-count, residence, security, and authorization limits.
Regulator: Montana Department of Revenue, Cannabis and Alcohol Regulation Division (CARD)
License classes:
Caps: SB 27 extends the moratorium on new marijuana-business licenses through June 30, 2027. Applications tied to an existing premises, including relocations and transfers, remain allowed.
Integration model: Vertical integration is permitted: a cultivator may operate adult-use dispensaries and manufacture products, but it is not required.
Round status: New-entrant licensing is expected to reopen July 1, 2027. Confirm current CARD guidance for transfers, relocations, and any legislative change.
Local control: Adult-use sales are limited to green counties; red counties remain medical-sales-only. Localities may also levy up to a three percent local-option tax.
Jobs outlook: A license moratorium restricts new-operator hiring, while licensed facilities in green counties continue to need permitted workers in cultivation, retail, manufacturing, testing, transport, and compliance.
