Cannabis Laws by State
Mississippi is medical-only. Registered patients can purchase medical cannabis in defined Mississippi Medical Cannabis Equivalency Units (MMCEUs), while recreational possession and home growing remain illegal. The state has no overall license cap: MSDH regulates most establishment types and work permits, while MDOR licenses dispensaries.
Not legal advice. NugWork does not offer legal advice or make legal claims, and these articles are not a substitute for professional legal counsel. These pages are summaries only, not exhaustive statements of the law, and cannabis laws change frequently and vary by state and locality.
Patients may purchase up to 6 MMCEUs per week and 24 per 30 days, and may possess up to 28 MMCEUs at one time. One MMCEU equals 3.5 grams of flower, 1 gram of concentrate, or 100 mg of infused product; flower is capped at 30% THC and tinctures, oils, and concentrates at 60%. First-offense non-patient possession of 30 grams or less is fine-only, but it is not legal access.
Mississippi does not permit patients or caregivers to grow cannabis at home. Cultivation is reserved for licensed cultivators, and unlicensed cultivation remains subject to general drug-law penalties.
Neither being 21 or older nor holding medical authorization creates a personal grow right in Mississippi. Cultivation is limited to licensed businesses or another explicit state-law exception, so a person should not start plants without a current legal basis.
License classes:
Caps: Mississippi has no statutory statewide cap on license numbers. Early 2023 reporting listed 138 provisional dispensaries, 47 cultivators, and 8 processors; later estimates of active dispensaries are secondary and should be rechecked.
Integration model: Vertical integration is permitted, subject to ownership limits set by MMCP rule.
Round status: Licensing is rolling. MDOR states it issues dispensary licenses within 30 days after a complete application.
Local control: Cities and counties had a 2022 opt-out window, with a referendum route to reverse an opt-out. Jurisdictions that stayed in may set time, place, and manner zoning rules but may not ban or make operation impracticable.
Jobs outlook: The uncapped, vertically integrable market supports steady hiring across dispensaries and production, though patient growth has been modest and no evidence supports a booming-market claim.

Work-permit and license applicants must have no disqualifying felony offense. The definition centers on crimes of violence and certain controlled-substance felonies, but prior conduct that likely would have been lawful under the Medical Cannabis Act is explicitly not disqualifying. The Medical Cannabis Program does not publish a controlled-substance-felony lookback period.
No. Mississippi has a medical cannabis program, but recreational possession and home cultivation remain illegal. A first possession offense of 30 grams or less is generally fine-only, which is not the same as legalization.
Registered patients may buy up to 6 MMCEUs weekly and 24 per 30 days, and may possess up to 28 MMCEUs. One MMCEU equals 3.5 grams of flower, 1 gram of concentrate, or 100 mg of infused product; verify current MMCP guidance after the 2025 law change.
No. Home cultivation is illegal for patients, caregivers, and adults. Only licensed cultivators may grow cannabis for the medical program.
Yes. Every employee of a licensed medical cannabis establishment must obtain an MSDH/MMCP work permit before starting work. The permit costs $25, lasts five years, and requires fingerprint background checks.
Not automatically. Mississippi bars people with disqualifying felony offenses, but conduct that likely would have been lawful under the Medical Cannabis Act is expressly excluded from that definition. The statute's specific lookback treatment for other controlled-substance felonies should be verified for an individual case.
