Cannabis Laws by State
Florida is medical-only. Qualified patients may purchase flower and other regulated products from licensed Medical Marijuana Treatment Centers, while adult-use possession, retail access, and home growing remain illegal. The 2024 adult-use amendment failed, and the follow-up 2026 initiative did not qualify for the ballot.

Florida is medical-only. The 2024 adult-use amendment failed, and the follow-up 2026 initiative did not qualify for the ballot.
Medical patients may purchase up to 2.5 ounces of smokable flower in each 35-day period and possess up to 4 ounces for smoking, subject to physician-requested exceptions. Non-smokable products have route-specific daily and 70-day THC caps, and purchases are recorded in the Medical Marijuana Use Registry. Non-patient possession is not legal statewide.
Florida reserves cultivation for licensed MMTCs. Personal cultivation is illegal for everyone, including qualified patients, and can be prosecuted under the state controlled-substances law.
Neither being 21 or older nor holding medical authorization creates a personal grow right in Florida. Cultivation is limited to licensed businesses or another explicit state-law exception, so a person should not start plants without a current legal basis.
Regulator: Florida Department of Health Office of Medical Marijuana Use (OMMU)
License classes:
Caps: Florida had 28 licensed MMTCs; late-May 2026 reporting described roughly 25 active operators with 766 dispensing locations, but OMMU counts change weekly.
Integration model: Vertical integration is mandatory: an MMTC cultivates, processes, transports, and dispenses medical marijuana under one license.
Round status: No open application window was confirmed. Statutory patient-based license additions and the Pigford/Black-farmer license process have been slow and litigation-heavy.
Local control: Local governments may prohibit dispensing facilities, but if they allow them they cannot cap their number or regulate them more restrictively than pharmacies.
Jobs outlook: The large medical market supports roles across cultivation, processing, transport, and retail within vertically integrated operators; hiring tracks MMTC and dispensary expansion.

MMTC Level 2 screening is restrictive. Disqualifiers include the general section 435.04 offenses and, for MMTC work, specified perjury, racketeering, money-laundering, and felony or minor-involving drug offenses, including cannabis offenses. Eligibility can depend on the screening rules that apply to the specific MMTC role.
No. Florida remains medical-only. The 2024 adult-use amendment did not receive the required 60% vote, and the follow-up 2026 initiative failed to qualify for the ballot.
For smoking, a qualified patient may buy up to 2.5 ounces of flower per 35-day period and possess up to 4 ounces, subject to physician-requested exceptions. Non-smokable products have separate route-specific daily and 70-day THC limits.
No. Florida limits cultivation to licensed MMTCs, so personal home growing is illegal even for qualified patients.
No. Florida does not use an individual agent-card system. MMTC employees, owners, and managers must pass employer-initiated Level 2 background screening before beginning work, and employees must be at least 21.
Yes. Florida MMTC screening includes felony drug offenses, including cannabis offenses, among the disqualifying criteria. Florida has a general screening exemption process for some offenses, so applicants with older convictions should check their eligibility directly with the employer or the exemption program rather than assume automatic disqualification.
