Cannabis Laws by State
Georgia has a limited medical-cannabis program, not adult-use legalization. Since July 1, 2026, registered patients may possess permitted medical-cannabis products totaling up to 12,000 mg THC, replacing the old 5% low-THC-oil cap. Smoking flower, home cultivation, and recreational possession remain illegal.

Registered Georgia patients and caregivers may possess properly labeled permitted products with a cumulative total of 12,000 mg or less of THC. SB 220 allows qualifying patients 21 and older to vaporize permitted products, but smoking botanical cannabis and food-infused cannabis remain prohibited. Unregistered possession of less than one ounce of marijuana is a misdemeanor; more than one ounce is a felony under state law.
Georgia does not authorize home cultivation for patients, caregivers, or adults. Production is limited to licensed indoor production companies, and personal cultivation is prosecuted as manufacture under the controlled-substances law.
Neither being 21 or older nor holding medical authorization creates a personal grow right in Georgia. Cultivation is limited to licensed businesses or another explicit state-law exception, so a person should not start plants without a current legal basis.
Regulator: Georgia Access to Medical Cannabis Commission (GMCC)
License classes:
Caps: Georgia permits up to 2 Class 1 and 4 Class 2 production licenses; GMCC reported 19 dispensing licenses statewide in mid-2026.
Integration model: Production licensees operate dispensaries in practice; no standalone non-producer retail license was identified, apart from an unresolved pharmacy channel.
Round status: GMCC reported no open production-license requests for proposals. SB 220 requires rulemaking before expanded products reach shelves.
Local control: Local governments control zoning for dispensing locations; no statewide opt-out tally was identified.
Jobs outlook: The small, capped market concentrates jobs in production and licensee-operated dispensing. SB 220 implementation may create manufacturing and retail demand as rules and products roll out.
